Terms of Sales

ARTICLE V: Cancellation Policy

- Regulatory travel/lease ban: full refund.

- Adverse weather (persistent heavy rain for several hours, wind > force 4): 50% refund or reschedule to a later date based on availability.

- Client cancellation > 15 days: 50% refund

- Client cancellation < 15 days: no refund

- Rental cancellation: no compensation, full refund

Rental Contract for Pardo 38 Timautine

(hereinafter referred to as "the owner" or "the lessor")

(hereinafter referred to as "the renter")

 

The renter accepts the special and general conditions of the contract by paying the deposit.

 

SPECIAL CONDITIONS

 

ARTICLE I: Skipper Responsibility

1. The renter must assume the role of skipper or hire a qualified skipper.

2. The renter has hired the professional skipper:

   Gregory Billon, 386 avenue de Cannes, 06210 Mandelieu-la-Napoule

   Siren: 811226679, professional skipper,

   License: 10542731 / 01 Holder: 20186815

   A contract has been signed between the skipper and the renter.

 

ARTICLE II: Vessel

Power: 221 kW (x2) 

Location: Port of Mandelieu-la-Napoule 

Max passengers: 11 + skipper 

Navigation zone: 60 miles from shelter.

 

ARTICLE III: Duration

  DAY: 9:30AM-5:00PM           SUNSET: 6:30PM -11:00PM         FULL DAY: 9:30 AM-11:00PM

- Overtime: €250 incl. VAT/hour, €70 incl. VAT/15 minutes of delay.

 

ARTICLE IV: Price

- DAY: €2400 incl. VAT

- SUNSET: €1400 incl. VAT

- FULL DAY: €3000 incl. VAT

- Payment: 100% upon reservation.

 

ARTICLE V: Cancellation Policy

GENERAL CONDITIONS

 

Owner's Obligations:

1. Provide a vessel compliant with laws.

2. Ensure the safety and insurance of the vessel.

 

Renter's Obligations:

1. Use the boat reasonably and comply with regulations.

2. Do not sublease or lend the boat.

3. Return the boat on time and in good condition.

4. Immediately inform the owner in case of accident or damage.

5. Do not make repairs without prior consent.

 

TAKING POSSESSION

1. The renter takes possession after payment of the balance and deposit.

2. The renter accepts the boat after inspection and inventory.

3. The owner may refuse to hand over the boat if the renter is deemed unfit to navigate.

 

USE – RESPONSIBILITIES – DAMAGE

1. The renter is responsible for damage not covered by insurance.

2. The renter must use the boat in accordance with maritime regulations.

3. In case of serious damage, the renter must notify the owner and obtain a report.

 

RETURN

1. The renter must return the boat to the designated port on time.

2. Each quarter-hour of delay will be charged €70 incl. VAT.

3. In case of inability to return, storage and transport costs may be charged.

 

DAMAGE OR LOSS

1. The renter must pay for repairs or replacement of damage or loss not covered by insurance.

2. The security deposit may be used to cover repair costs.

 

INSURANCE

1. The boat is insured under contract no. YG2009146 with Yacht Guard.

2. The insurance premium is included in the rental price.

3. Personal effects are not insured.

 

CANCELLATION AND TERMINATION

1. Cancellation within 15 days: 100% of deposits retained by the lessor.

2. In case of non-conformity of the boat, the renter may terminate the contract and obtain a refund.

 

CONSUMABLES

All consumables (fuel, water) are the renter's responsibility.

 

SECURITY DEPOSIT

The deposit is paid 72 hours before taking charge and guarantees damage or loss attributable to the renter.

 

DISPUTES

The applicable law is French law and the competent courts are French courts.
